The website www.piesetransilvane.ro is administered and operated by PIESE TRANSILVANE SRL, a Romanian legal entity with its registered office in Comuna Brădești, Str. Bethlen Gabor No. 5, registered with the Trade Register under no. J2021000043196, having fiscal identification code RO43601756, hereinafter referred to as the “Seller”.
Accessing and using the website, creating an account, or placing an order constitutes the user’s express agreement to fully and unconditionally accept these Terms and Conditions. The Seller reserves the right to modify or update the content of this document at any time without prior notice, with changes becoming effective from the date of publication on the website.
For the purpose of this document, “Seller” refers to PIESE TRANSILVANE SRL, “Buyer” refers to any natural or legal person placing an order, “Visitor” refers to any person accessing the website, “Goods” refer to new and aftermarket spare parts for construction machinery, and “Contract” refers to the order confirmed by the Seller.
The products marketed through the website consist of new and aftermarket spare parts intended for construction machinery. Product descriptions and images are for informational purposes only. The Seller makes every effort to ensure accurate presentation but does not guarantee the absence of minor design or appearance differences that do not affect the functionality of the product.
The correct identification of the required spare part is the sole responsibility of the Buyer. To avoid errors, the Buyer must verify and provide complete information, including the machine serial number, the original part code, relevant photos of the old part (if applicable), as well as exact dimensions and technical specifications. The Seller may provide informational support based on the data supplied; however, the final decision regarding compatibility and proper fit remains entirely the Buyer’s responsibility.
The Seller cannot be held liable for ordering the wrong part, incompatibility resulting from incomplete or incorrect information, or minor design differences that do not affect functionality.
Product prices are expressed in RON and do not include VAT, which will be shown separately in accordance with applicable tax legislation. The Seller reserves the right to modify prices at any time without prior notice; however, such changes will not affect already confirmed orders.
Payment may be made via cash on delivery, online card payment, or bank transfer, under the conditions displayed on the website at the time of placing the order.
Delivery of products is carried out through a courier service. The shipping cost is displayed before finalizing the order. The estimated delivery time is 1–5 business days, depending on product availability and delivery location.
The risk related to the products transfers to the Buyer at the moment the package is handed over to the courier company. The Buyer is required to check the integrity of the package upon receipt and report any visible damage at the time of delivery.
In accordance with Government Emergency Ordinance (GEO) 34/2014, natural persons have the right to withdraw from the contract within 14 calendar days from receiving the product, without providing a reason.
To exercise the right of withdrawal, the product must be unused, in its original packaging, and without installation marks. Returns are not accepted for products damaged through use or for products specially ordered or imported at the Buyer’s express request.
The cost of return shipping is borne by the Buyer. The refund will be made within a maximum of 14 days from the receipt and verification of the returned product.
For certain products, a warranty is granted in accordance with applicable legislation for a period of 12 months.
The warranty is valid exclusively if the part was installed in an authorized service center and this is proven by appropriate supporting documentation confirming the installation.
The warranty does not cover defects caused by normal wear and tear, improper installation, or incorrect use of the product. The Seller is not responsible for labor costs, dismantling, transport, or any commercial losses resulting from product failure.
For products specially ordered or imported at the Buyer’s express request, order cancellation after confirmation is not accepted, and returns are not permitted.
The Seller cannot be held liable for indirect damages, production losses, commercial losses, or any other damages resulting from improper use of the marketed products.
Neither party shall be liable for total or partial failure to perform contractual obligations if such failure is caused by a force majeure event as defined by Romanian law.
Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR). The processed data may include full name, delivery address, email address, phone number (if provided), and billing details.
The data is used for order processing and confirmation, organizing delivery, issuing invoices, maintaining customer relations, sending newsletters and commercial communications based on the User’s prior consent, and conducting advertising and promotional campaigns.
Data processing for marketing purposes is carried out exclusively based on the User’s freely given consent, which may be withdrawn at any time. Data may be transmitted to courier companies, payment processors, or marketing service providers under data processing agreements.
This document is governed by Romanian law. Any disputes arising between the parties shall be resolved amicably, and if such resolution is not possible, jurisdiction lies with the competent courts of Romania.
